Terms of Business

This document outlines the ‘terms of business’ between you and us. 

Aviva Health Insurance Ireland Limited, is a health insurance company which underwrites non-life insurance in the following classes, 1 & 2. Aviva Health Insurance Ireland Limited, part of Aviva Group (Ireland) plc, has its registered office at One Park Place, Hatch Street, Dublin 2. Its Company Registration Number is: 376607. Aviva Health Insurance Ireland Limited may be contacted by phone on 1850 717 717. 

Aviva Health Insurance Ireland Limited, is regulated by the Financial Regulator. Aviva Health Insurance Ireland Limited is also entered upon the Register of Health Benefit Undertakings maintained by the Health Insurance Authority. 

Aviva is a health insurance provider. If you have purchased a hospital plan, your policy covers you for inpatient and outpatient medical expenses. If you have purchased a day-to-day plan this covers some of your day-to-day medical expenses.

We have in place policies for our employees in relation to conflicts of interest. These are designed to ensure that potential conflicts of interest between you and us or our employees are avoided.

All payments must be paid in euro and must be either by direct debit, Laser card or credit card, cheque, cash or salary deduction. Credit card and laser card payments will only be accepted in two circumstances:

To pay your yearly premium in advance; or

If your monthly premium is late and we have informed you of such. 

Should the account, from which the Direct Debit is to be requested, require more than one person to authorise such direct debits, a direct debit mandate with both relevant signatures must be submitted in conjunction with a paper application form.

If you do not pay your premium on time Aviva may cancel your policy with effect from the date the first missed payment was due and not received.

Aviva Health Insurance Ireland Limited(“we”, “us” or “our”), as data controller, will keep the information you provide about yourself and about third parties confidential. We may use it to advise on, provide and administer insurance products and financial services provided by us or other Aviva Group plc companies and sometimes with our affiliates and/or commercial partners and in order to comply with legal obligations imposed on us. We may share the information both inside and outside of the European Economic Area, in confidence, for these purposes with agents or service providers we have appointed, private investigators, regulatory organisations, other insurance and financial services companies (directly or via a central register), other Aviva group plc companies, those to whom we outsource certain business operations and as required by law. To assist in preventing, detecting and/or protecting our customers and ourselves from theft and fraud, we may use your information to make searches of our or other Aviva companies’ records, as well as those of other health insurers. If you give us false information or fail to disclose information and we suspect fraud, we will record this. We also participate in industry databases such as those operated by the Irish Insurance Federation for the purpose of sharing of information among insurance companies as a check against non-disclosure.

If you would like a copy of the details we hold about you, please write to: The Customer Services manager, Aviva Health Insurance Ireland Limited, One Park Place, Hatch Street, Dublin 2. Please enclose the correct fee (€6.35). You also have the right to correct any errors in the information held about you, block certain uses or object to the processing of your personal data.
 

Declaration

By using this application you are confirming that, all the details, answers and information given are true, accurate and complete. You acknowledge that this proposal will form the basis any quote received or subsequent contract with Aviva Health Insurance Ireland Limited should you accept the quote provided.

By using this application you are giving us permission to process these details for the above purposes, including checking with third parties or accessing State or other official records to verify whether the details you have given are accurate and complete. You are confirming that you have fully explained to each person who requires / may require this insurance cover why we asked for this information and what we will use it for. You are also confirming each person has agreed to this.

You are confirm that you are giving your permission to  Aviva to use the information given on this form in accordance with the information set out in the Data Protection section above.
 

Collection & Use of Technical Information

Cookies are small pieces of information, stored in simple text files and sometimes placed on your computer by a website. Aviva uses cookies to monitor our website traffic, to enable better service levels and to enable you to log onto our website automatically if you wish.

Aviva  shall record Instructions received by electronic means via any of our online applications and, in the event of any dispute arising in relation to any instructions or alleged instructions, the record so kept by Aviva shall be proof of such instructions or alleged instructions for the purpose of such dispute.

Aviva Health Insurance Ireland Limited is licensed to underwrite health coverage in the Republic of Ireland only and does not engage in the business of insurance outside Ireland, except as may be permitted by law. Nothing contained in this website, with the exception of the Buy Now, Member Self Service and Scheme Administration sections, shall constitute a solicitation, offer or acceptance of a contract of insurance or be construed as creating or modifying any agreement with Aviva Health Insurance Ireland Limited.

This agreement and the resolution of any dispute related to this agreement or these sites shall be governed by and construed in accordance with the laws of Ireland. Any legal action or proceeding between Aviva and you, related to this agreement or these sites shall be brought exclusively in a court of competent jurisdiction sitting in Ireland.

Alteration of the Terms & Conditions

These terms and conditions may be altered by Aviva at its discretion from time to time and will be altered by Aviva to comply with any regulatory directive or to enhance the security of our online applications. Any such alteration will be notified to you by a posting an updated version of the terms and conditions on the applicable Website.

Communication

Communications between application users and Aviva via the e-mail addresses provided are not encrypted - please do not use these services if this causes you concern. 

Terms of Use specific to Buy Now

Access

Access to BUY NOW is provided on the understanding that:

BUY NOW is provided to allow users to receive quotes for and purchase Aviva private medical insurance from Aviva. Policyholders act for all members included on the policy. Use for any other purpose is prohibited. Aviva will endeavour to provide access to the system at the agreed times, but no warranty is given. Aviva may terminate access at its own discretion.
 

Data

The Policyholder undertakes that, to the best of his/her knowledge and belief, any information provided via BUY NOW is true and complete. Inappropriate use of BUY NOW will result in access being revoked by Aviva. The information disclosed by BUY NOW is within the terms of Aviva Health Insurance Ireland Limited's registration under the Data Protection Act 1988 and 2003.
 

Acting on Instructions

The Policyholder authorises Aviva to act upon all instructions received in respect of his policy or policies which have been or appear to Aviva to have been issued by the Policyholder, without taking any further steps to authenticate such instructions. Aviva will accept instructions from Policyholders 24 hours a day, 365 days of the year. Instructions will be effected as soon as is reasonably possible.
 

Terms of Use specific to Member Self Service

Access

Access to Member Login is provided on the understanding that:

Member Self Service is provided to allow registered current Policyholders to view and administer their health insurance cover from Aviva. Policyholders act for all members included on the policy. Use for any other purpose is prohibited. Aviva will endeavour to provide access to the system at the agreed times, but no warranty is given. Aviva may terminate access to Member Login at its own discretion. 
 

Data

The Policyholder undertakes that, to the best of his/her knowledge and belief, any information provided via Member Login is true and complete. Inappropriate use of Member Login will result in access to Member Login being revoked by Aviva. The information disclosed by Member Login is within the terms of Aviva Health Insurance Ireland Limited 's registration under the Data Protection Act 1988 and 2003.
 

Security/ Authentication

Aviva will then provide the Policyholder with a Username and Password, which the Policyholder must provide on request on each occasion the Policyholder accesses Member Login.

The Policyholder:
Must keep their login details secret;
Must not record their login details in a form or manner which would be intelligible or otherwise accessible to an unauthorised person;
Must notify Aviva immediately, should the Policyholder either suspect or become aware that their Login Details become known or available to an unauthorised person.


 

Acting on Instructions

The Policyholder authorises Aviva to act upon all instructions received in respect of his policy or policies (once accompanied by the appropriate login details) which have been or appear to Aviva to have been issued by the Policyholder, without taking any further steps to authenticate such instructions. Aviva will accept instructions from Policyholders 24 hours a day, 365 days of the year. Instructions will be effected as soon as is reasonably possible.
 

Terms of Use specific to Scheme Administration Site

Access

Access to Aviva's Scheme Administration Site is provided on the understanding that: Access is provided to assist authorised users in the administration of Schemes. Use for any other purpose is prohibited. Aviva will endeavour to provide access to the system at the agreed times, but no warranty is given. Aviva may terminate access to the Scheme Administration Site at its own discretion. The information disclosed by Aviva’s health insurance Scheme Administration Site is within the terms of Aviva Health Insurance Ireland Limited's registration under the Data Protection Act 1988. The PC screens must only be visible to Authorised Users who require such access. All financial values displayed are in Euros.

 

Data

The Scheme Administrator undertakes that, to the best of his/her knowledge and belief, any information provided via the Scheme Administration Site is true and complete. Inappropriate use of the Scheme Administration Site will result in access being revoked by Aviva. The information disclosed by the Scheme Administration Site is within the terms of  Aviva Health Insurance Ireland Limited's registration under the Data Protection Act 1988 and 2003.
 

Security/Authentication

Aviva will then provide the Scheme Administrator(s) with a Username and Password, which they must provide on request on each occasion they access the Scheme Administration Site

The Scheme Administrator(s):
Must keep their login details secret;
Must not record their login details in a form or manner which would be intelligible or otherwise accessible to an unauthorised person;
Must notify Aviva immediately, should they either suspect or become aware that their Login Details become known or available to an unauthorised person.

 

Acting on Instructions

By submitting instructions via this site you are declaring the Policyholder has authorised you to act on their behalf, permitting Aviva to act upon all instructions received in respect of his / her policy or policies (once accompanied by the appropriate login details) which have been or appear to Aviva to have been issued by the Scheme Administrator, without taking any further steps to authenticate such instructions. Aviva will accept instructions from Scheme Administrators 24 hours a day, 365 days of the year. Instructions will be effected as soon as is reasonably possible.
 

Terms of Use specific to Intermediary Portal

Access

Access to Aviva's Health Insurance Intermediary Portal is provided on the understanding that:

Access is provided to assist authorised users in the administration of Schemes / Policies. Use for any other purpose is prohibited. Aviva will endeavour to provide access to the system at the agreed times, but no warranty is given. Aviva may terminate access to the Intermediary Portal at its own discretion. The information disclosed by Aviva’s Health Insurance Intermediary Portal is within the terms of Aviva Health Insurance Ireland Limited's registration under the Data Protection Act 1988. The PC screens must only be visible to Authorised Users who require such access. All financial values displayed are in Euros.
 

Data

The Intermediary undertakes that, to the best of his/her knowledge and belief, any information provided via the Intermediary Portal is true and complete. Inappropriate use of the Intermediary Portal will result in access being revoked by Aviva. The information disclosed by the Intermediary Portal is within the terms of Aviva Health Insurance Ireland Limited's registration under the Data Protection Act 1988 and 2003. 
 

Security/ Authentication

Aviva will then provide the Intermediary with a Username and Password, which they must provide on request on each occasion they access the Intermediary Portal.

The Intermediary:
Must keep their login details secret;
Must not record their login details in a form or manner which would be intelligible or otherwise accessible to an unauthorised person;
Must notify Aviva immediately, should they either suspect or become aware that their Login Details become known or available to an unauthorised person.
 

Acting on Instructions

By submitting instructions via this site you are declaring the Policyholder, or scheme through which the policyholder’s policy or policies is administered, has authorised you to act on their behalf, permitting Aviva to act upon all instructions received in respect of his / her policy or policies (once accompanied by the appropriate login details) which have been or appear to Aviva to have been issued by the Intermediary, without taking any further steps to authenticate such instructions. Aviva will accept instructions from Intermediaries 24 hours a day, 365 days of the year. Instructions will be effected as soon as is reasonably possible.
 

Terms of Use specific to Provider Portal

Access

Access to the Aviva's Health Insurance Provider Portal is provided on the understanding that:
Access is provided to assist authorised users in the administration of client claims. Use for any other purpose is prohibited. Aviva will endeavour to provide access to the system at the agreed times, but no warranty is given. Aviva may terminate access to the Provider Portal at its own discretion. The information disclosed by Aviva’s health Insurance Provider Portal is within the terms of  Aviva Health Insurance Ireland Limited's registration under the Data Protection Act 1988. The PC screens must only be visible to Authorised Users who require such access. All financial values displayed are in Euros.
 

Data

The Patients Accounts Administrator undertakes that, to the best of his/her knowledge and belief, any information provided via the Provider Portal is true and complete. Inappropriate use of the Provider Portal will result in access being revoked by Aviva. The information disclosed by the Provider Portal is within the terms of Aviva Health Insurance Ireland Limited's registration under the Data Protection Act 1988 and 2003. 
 

Security/ Authentication

Aviva will then provide the Patients Accounts Administrator with a Username and Password, which they must provide on request on each occasion they access the Provider Portal.

The Patients Accounts Administrator(s):
Must keep their login details secret;
Must not record their login details in a form or manner which would be intelligible or otherwise accessible to an unauthorised person;
Must notify Aviva immediately, should they either suspect or become aware that their Login Details become known or available to an unauthorised person.
